PRIVACY AND COOKIE USE POLICY

§ 1. General provisions
- Privacy policy and use of cookies on the website https://hostelkc.pl (hereinafter referred to as the "Policy") was created and adopted by Hostel Katowice Centrum.
- The terms used in the Policy mean:
- Service: website https://hostelkc.pl;
- User: an entity using the publicly available Website;
- Owner: NAP Grzegorz Kukiz, with its registered office in Koźmice Małe 159, 32-030 Wieliczka, NIP 7921045840, REGON 650888396
- Cookies: text files sent by the Service and saved on the User's end device, which the User uses when browsing websites. The files contain information necessary for the proper functioning of the Service. Cookies most often contain the name of the domain of the website from which they originate, the time of their storage on the end device and a number;
- The purpose of the Policy is in particular:
- providing Users with information on the use of Cookies on the Website, required by law, including the Telecommunications Law;
- ensuring Users’ privacy protection to the extent that it complies with the standards and requirements specified in applicable legal provisions.
- The Owner limits the collection and use of information about Users to the minimum necessary to provide services to them.
- In order to obtain full access through the Website to the content and services offered by the Owner, it is advisable to accept the principles set out in the Policy.
- The following legal provisions, among others, apply:
- Act of 16 July 2004 – Telecommunications Law (Journal of Laws of 2017, item 1907, as amended);
- Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2017, item 1219, as amended);
- Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 4.5.2016) together with Polish provisions on personal data protection.
§ 2. Protection of privacy and personal data
- Data concerning Users are processed by the Owner in accordance with the provisions of the law. The personal data of Users obtained by the Owner are processed on the basis of the consent granted by the User or the occurrence of another premise authorizing the processing of data in accordance with the provisions, in particular the Regulation.
- The Owner takes special care to protect the interests of data subjects and in particular ensures that the data is:
- processed lawfully, fairly and transparently for Customers and other data subjects;
- collected for specified, explicit and legitimate purposes and not further processed in a manner incompatible with those purposes;
- adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
- correct and updated as necessary;
- kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed;
- processed in a way that ensures appropriate security of personal data, including protection against unauthorised or unlawful processing and accidental loss, destruction or damage, using appropriate technical or organisational measures,
- The Owner applies appropriate technical and organisational measures to ensure the protection of processed personal data appropriate to the nature, scope, context and purposes of processing and the risk of infringement of the rights or freedoms of natural persons.
- The Owner strives to systematically modernize the IT, technical and organizational measures used to protect this data, in particular the Owner ensures updates of IT security measures to protect against viruses, unauthorized access and other threats resulting from the operation of the IT system and telecommunications networks.
- The Owner provides each User who has made their data available to the Owner in any way with access to the data and the exercise of other rights to data subjects in accordance with the applicable legal provisions in this respect, including the following rights:
- the right to withdraw consent to the processing of personal data;
- the right to information regarding their personal data;
- the right to control the processing of data, including its supplementation, updating, rectification and deletion;
- the right to object to processing or to restrict processing;
- the right to complain to the supervisory authority and to use other legal means to protect your rights.
- The Owner may process personal data in an automated manner, including through profiling, on the principles resulting from the Regulation. In such a case, the purpose of the Owner's actions are marketing purposes or the need to personalize messages sent to Users (including matching information to the needs or expectations of the User). The User has the right to object to such processing of his data - this objection may be expressed by sending a message to the Owner's address: agawajda@autograf.pl.
- A person having access to personal data processes it only on the basis of the Owner’s authorisation or a personal data processing agreement and only on the Owner’s instructions.
§ 3. Cookies
- Cookies identify the User, which allows the content of the website they are using to be tailored to their needs. By remembering their preferences, it enables the appropriate adjustment of content directed to them, including advertisements. The Owner uses Cookies to guarantee an appropriate standard of convenience of the Service, and the collected data is used only within the company to optimize activities.
- Cookies are used for the following purposes:
- adapting the content of the Website to the User’s preferences;
- optimizing the use of the Website, in particular by recognizing the User’s end device,
- creating statistics,
- maintaining the User's session,
- providing the User with advertising content.
- Cookies may be placed on the end device of the Website User.
- The collected data is used to monitor and verify how Users use the Website in order to improve the functioning of the Website by ensuring more efficient and problem-free navigation.
- It should be remembered that in some cases, beyond the Owner's control, the software installed by the User on the end device, used to browse websites (e.g. a web browser) introduces the default storage of Cookies on the User's end device. Users can change the settings for Cookies at any time. These settings can be changed, among others, in such a way as to block the automatic setting of Cookies or inform about each time they are placed on the User's end device. Detailed information in this regard is available in the settings and instructions for the software (web browser).
- The user may at any time disable or restore the option of collecting cookies by changing the settings in the web browser.
- Changing the settings constitutes an expression of objection, which may cause difficulties in using the Service in the future. Completely disabling the option of accepting Cookies will not mean the inability to view the content posted on the Service, except for those to which access requires logging in.
- Failure to change the settings means that the data will be placed on the User's end device (using the Service will result in automatic placement of Cookies on the User's end device).
- The stored data placed on the User's end device do not cause any configuration changes in the User's end device or the software installed on that device.
- Information regarding Cookies also applies to other similar technologies used within the Service.
§ 4. Final provisions
- The Policy was adopted by order of the Owner and comes into effect on 12 December 2017. The content of the Policy may be changed in the same manner.
- Any deviations from the Policy must be made in writing under penalty of nullity.
- The law applicable to the Policy is the law of the Republic of Poland.
- In matters not regulated in the Policy, the relevant provisions of law shall apply.
